Someone hit an 8 point buck outside my house.......?

and i'd like to go get that rack and put it on my garage. i live in upstate NY and have hunted in this area for years and i've only ever got a 6 pointer and an 8 pointer would look good w/ my collection. does anyone know if i have to tag it(deer season's over) or call the health department or if i have to just let it sit there, any help would be appreciated
